Welcome to Lunchbox ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of our website located at https://lunchbox.cool (the "Site"), which is owned and operated by Pocae Pty Ltd, a company registered in Australia.

By using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

The Site is for informational purposes only. We provide meal planning and nutritional data based on the information you provide. However, we are not medical professionals, and the Site does not constitute medical advice, diagnosis, or treatment.

• You should consult with a physician or qualified healthcare professional before beginning any new diet, nutrition, or meal plan.

• You use the Site and any meal plans generated by it at your own risk.

We do our best to provide accurate nutritional data and clear cooking steps, but results can differ.

• We cannot guarantee that your meals will look exactly like the photos, or that they will suit your personal taste preferences.

• You are responsible for verifying ingredients (especially regarding dietary requirements), and using your best judgment when cooking.

• Age Requirement: You must be at least 18 years old to create an account and purchase a subscription. Individuals under 18 may use the Site only with the involvement and consent of a parent or legal guardian.

• Account Security: You are responsible for maintaining the confidentiality of your sign in credentials. You agree to notify us immediately of any unauthorised use of your account.

• Account Information: You agree to provide accurate and current information (such as your email and payment details) and keep them updated.

• Free Trial: We offer a one-month free trial for new users. No credit card is required to start the trial. At the end of the trial, you must enter valid payment details to continue using the Site.

• Subscription Fee: The Site is billed on a recurring monthly basis at $26 AUD per month.

• Billing Cycle: Your payment method will be charged automatically each month on the calendar day corresponding to the start of your paying subscription.

• Cancellations: You may cancel your subscription at any time using your account settings. If you cancel, no further charges will be made.

• No Refunds for Change of Mind: As we offer a free trial without requiring payment information, we do not offer refunds for "change of mind" once a subscription fee has been processed.

• Australian Consumer Law: Our Site comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL). These Terms do not exclude, restrict, or modify any rights you have under the ACL. If our Site fails to meet a statutory guarantee, you may be entitled to a remedy.

You may post, upload, or submit content to the Site, including meals, ingredients, utensils, steps, and photos ("User Content").

• License Grant: You retain ownership of your User Content. However, by uploading it, you grant Pocae Pty Ltd a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, display, distribute, and market your User Content in connection with the Site. You acknowledge and agree that we may use your User Content to train our algorithms, and recommendation engines to improve the Site for all users.

• Content Rules: You agree not to upload content that is illegal, offensive, defamatory, or infringes on the intellectual property rights of others.

• Right to Remove: We reserve the right to remove or modify any User Content at our sole discretion, without notice or liability, if we believe it violates these Terms or is otherwise harmful to the Site.

You agree not to:

• Illegal Use: Use the Site for any illegal purpose.

• Harassment: Harass, abuse, or harm another person using the Site.

• Account Sharing: Share your account credentials with others to avoid paying subscription fees.

• Data Mining & Scraping: Use any robot, spider, crawler, scraper, or other automated means not provided by us to access the Site or extract data.

• AI Training: Use any content from the Site to train artificial intelligence systems, large language models, or machine learning algorithms without our written permission.

• Reverse Engineering: Attempt to reverse engineer, decompile, or hack the Site.

We reserve the right to suspend or terminate your account and access to the Site immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

To the maximum extent permitted by law:

• Pocae Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site.

• Our total liability for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Site in the 12 months prior to the claim.

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales.
